TERMS & CONDITIONS
Fresh City strives to provide a quality food experience for our members. The following sets forth some key terms of the Fresh City bag program.
Satisfaction guarantee: We try our best to ensure the produce and products we include in your bag are great quality. If you are not happy with any given product, just let us know and we will credit your account or otherwise rectify the issue.
Cancellation: You can cancel your bag delivery service at any time as long as you let us know by the order change deadline -- 10am, one day before your scheduled delivery day.
Price changes: We will provide reasonable notice of any changes in bag prices. We will not notify members of weekly price changes in Market items -- however, the prices will never change after the order deadline passes so you will always be able to review prices of any items to which you have subscribed before your order is finalized.
Delivery hold: You can place your delivery service on hold at any time as long as you let us know by the order change deadline -- 10am, one day before your scheduled delivery day.
Adding to your order: You may add to or customize your local, organic bag order until your order change deadline (generally at 10am, one day before your scheduled delivery day).
Produce: All produce should be washed before use. The type or source of produce included in your bag may sometimes differ from the expected contents due to the perishable nature of produce. If you have made a custom order, we will not include the item and you will not be charged for it.
Delivery: We try to finish our deliveries by 9pm the day of delivery. Where that is not possible due to traffic, weather or other circumstances, we will try to deliver your bag the next day. In case of delivery delay, you may cancel your bag for that week and we will refund you the requisite amount. We reserve the right to cancel (with a full refund) or delay deliveries with notice due to inclement weather. We also reserve the right to cancel any future deliveries and refund any remaining paid amounts for any reason including discontinuation of a delivery route.
Bag Non-Return Charge: We reuse the bags over and over and over to keep costs down and to keep the planet up. Please leave your empty bag and any reusable packaging such as cooler bags, ice packs and glass jars outside your door (for homes), with security/concierge (for apartments/condos) or at your Pickup Hub (for pickup members). Non-returned Fresh City bags incur a fee of $6.50. The fee is charged if the bag is not returned within 110 days after delivery. We use the barcodes on the order's packing slip to determine whether the bag has been returned. The fee is refunded if the bag is returned within 365 days of delivery.
Pickup Hubs: If you chose the pickup option, you are responsible for picking up your Fresh City within the alloted time window for your Pickup Hub. Most Pickup Hubs cannot keep your bag overnight.

These terms may be changed by Fresh City Farms, Inc. at its sole discretion, at any time without notice. Use of this website constitutes your agreement to be bound by these terms.

Accessible Emergency Information
Fresh City is committed to providing the customers and clients with publicly available emergency information in an accessible way upon request. We will also provide employees with disabilities with individualized emergency response information when necessary.
Fresh City will provide training to employees on Ontario’s accessibility laws and on the Human Rights Code as it relates to people with disabilities. Training will be provided in a way that best suits the duties of employees, volunteers and other staff members. Fresh City will take the following steps to ensure employees are provided with the training needed to meet Ontario’s accessible laws:
- Accessibility training will be conducted for all employees as a part of their onboarding process.
- We will update all of our employees on an annual basis on any changes to our accessibility policy.
Information and Communications
Fresh City is committed to meeting the communication needs of people with disabilities. We will consult with people with disabilities to determine their information and communication needs. Upon request, we accommodate receiving feedback in a variety of formats including telephone, email, mail and in-person communication.
Fresh City is committed to fair and accessible employment practices. We will take the following steps to notify the public and staff that, when requested, will accommodate people with disabilities during the recruitment and assessment processes and when people are hired.
- Let job applicants know that we will accommodate disabilities during the selection process.
- If a job applicant requests accommodation, consult with them and make adjustments that best suit their needs.
- Notify successful applicants of our policies for accommodating employees with disabilities
Fresh City will take the following steps to develop and put in place a process for developing individual accommodation plans and return-to-work policies for employees that have been absent due to a disability.
- Develop individual accommodation plans and return-to-work policies for employees that have been absent due to a disability.
- Outline the steps we will take to help our employees return to work when they have been absent because of a disability, and need some form of disability-related accommodation to return to work
We will take the following steps to ensure the accessibility needs of employees with disabilities are taken into account if Fresh City is using performance management, career development and redeployment processes.
- Make performance management accessible by reviewing our employees’ accommodation plans to understand their needs and see whether we need to make adjustments to help them succeed
- Making performance management documents, such as performance plans, available in accessible formats, such as large print, when asked, and
- Providing feedback and coach your employees in a way that is accessible to them, such as using plain language for an employee who has a learning disability.
- When we provide career development opportunities, consider what accommodations your employees with disabilities may need to learn new skills, or take on more responsibilities in their current position;
- Consider what we could do to help our employees with disabilities succeed in other positions in our organization when they change jobs.
Fresh City will take steps to prevent and remove any other accessibility barriers as identified by the public, employees, and clients of Fresh City as required and requested.
Design of Public Spaces
Fresh City will meet the Accessibility Standards for the Design of Public Spaces when building or making major modifications to public spaces.
Accessible off street parking
Service-related elements like service counters, fixed queuing lines and waiting areas
Fresh City will put the following procedures in place to prevent service disruptions to its accessible parts of its public spaces. In the event of a service disruption, we will notify the public of the service disruption
and alternatives available.
